1. Acceptance of Terms

By downloading, installing, or using Mental Mamba (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Australa Limited ("we", "us", "our") regarding your use of the App. By using the App, you also agree to our Privacy Policy, which explains how we collect and use your information.

2. Description of Service

Mental Mamba is a mobile game that combines classic snake gameplay with mathematical challenges. The App includes features such as:

• Core gameplay (available without an account)
• Learning Mode with structured training modules and mastery tracking
• Mental Mamba PLUS premium subscription (ad-free, full Learning Mode access)
• Optional user accounts with email authentication
• Global leaderboards and rankings
• Achievements and progress tracking
• Game Center integration (iOS only)
• Cross-device progress sync for authenticated users
• Analytics to improve user experience

You may use the App without creating an account, but certain features (leaderboards, achievements, progress sync, full Learning Mode) require account creation or a PLUS subscription.

3. User Accounts and Authentication

3.1 Account Creation

To access certain features, you may create an account. Account creation requires providing a valid email address. We use a passwordless authentication system - you will receive a one-time verification code via email to log in.

3.2 Account Requirements

When you create an account, you agree to:

• Accurate Information: Provide a valid email address you have access to
• Age Requirement: Be at least 13 years old (or have parental consent if under 13)
• Unique Account: Create only one account per person
• Account Security: Maintain control of your email account used for authentication
• Appropriate Username: Choose a username that is not offensive, misleading, or infringes on others' rights
• Account Responsibility: Be responsible for all activities under your account
• Unauthorized Use: Notify us immediately at support.mentalmamba@australa.co if you suspect unauthorized access

3.3 Account Data and Consent

By creating an account, you consent to the collection, storage, and processing of your data as described in our Privacy Policy. This includes:

• Email address for authentication and communication
• Username and profile information
• Game statistics, scores, and achievements
• Usage analytics and session data linked to your account

You can delete your account at any time through the Account Settings in the App or by contacting us.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You may not:

• Cheat, hack, or use unauthorized third-party software
• Exploit bugs or glitches for unfair advantage
• Harass, abuse, or harm other users
• Share inappropriate content or usernames
• Attempt to reverse engineer or modify the App
• Use the App for commercial purposes without permission

5. User-Generated Content

Any content you create or share through the App (usernames, messages, etc.) must comply with our community guidelines. We reserve the right to remove any content that violates these Terms.

6. Intellectual Property

The App and all its contents, features, and functionality are owned by Mental Mamba and are protected by copyright, trademark, and other intellectual property laws.

7. Mental Mamba PLUS Subscription and In-App Purchases

7.1 Subscription Service

Mental Mamba offers a premium subscription service called "Mental Mamba PLUS" which provides access to enhanced features including:

• Ad-free experience across the entire App
• Access to all Learning Mode modules and structured training paths
• Advanced progress tracking and achievement milestones
• Priority access to new features and content
• Future premium features as they become available

7.2 Subscription Plans and Pricing

Mental Mamba PLUS is available in three subscription options:

• Mental Mamba PLUS Monthly:
  • Length of subscription: 1 month
  • Price: As displayed in the App Store (varies by region)
  • Billed monthly with automatic renewal
  • Cancel anytime before renewal to avoid next charge
• Mental Mamba PLUS Yearly:
  • Length of subscription: 1 year (12 months)
  • Price: As displayed in the App Store (varies by region, discounted compared to monthly)
  • Billed annually with automatic renewal
  • Cancel anytime before renewal to avoid next charge
• Mental Mamba PLUS Lifetime:
  • Length of subscription: Lifetime (permanent access)
  • Price: One-time payment as displayed in the App Store (varies by region)
  • No automatic renewal - permanent access after purchase

Important: Subscription pricing is displayed in the App and may vary by region based on your local currency and applicable taxes. All prices are set by and displayed in Apple's App Store at the time of purchase. The exact price will be shown to you before you complete your purchase.

7.3 Free Tier

Mental Mamba offers a free tier with access to core gameplay features. Learning Mode is limited to a selection of introductory modules in the free tier. A Mental Mamba PLUS subscription is required to access the complete Learning Mode library.

7.4 Payment and Billing

All subscriptions are processed through the Apple App Store. By subscribing, you agree to:

• Pay the subscription fee at the start of your subscription period
• Authorize Apple to charge the payment method associated with your Apple ID
• Accept that all billing is handled by Apple in accordance with Apple's Terms of Service
• Understand that we do not have access to your payment information

Your subscription will be charged to your Apple ID account at confirmation of purchase.

7.5 Auto-Renewal (Monthly and Yearly Plans Only)

Monthly and Yearly subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price as the original subscription unless we notify you in advance of a price change.

To turn off auto-renewal:

• Open your device's Settings
• Tap your name at the top
• Tap "Subscriptions"
• Select Mental Mamba PLUS
• Tap "Cancel Subscription"

You may also manage your subscription and turn off auto-renewal through the Mental Mamba app by tapping "Restore Purchases" on the subscription screen.

7.6 Cancellation Policy

You may cancel your subscription at any time through your Apple ID subscription settings. Cancellation will take effect at the end of your current billing period. You will continue to have access to PLUS features until the end of your paid period.

Cancelling your subscription:

• Does not entitle you to a refund for any unused portion of the subscription period
• Takes effect at the end of the current billing cycle
• Means you will retain PLUS access until the subscription expires
• Will revert your account to the free tier after expiration

7.7 Refund Policy

All purchases are processed through Apple's App Store and are subject to Apple's refund policies. Generally, all sales are final unless required by applicable law. To request a refund:

• Visit reportaproblem.apple.com
• Sign in with your Apple ID
• Find the Mental Mamba PLUS purchase
• Follow Apple's refund request process

We cannot process refunds directly as all transactions are managed by Apple. Refund approval is at Apple's sole discretion.

7.8 Restoration of Purchases

If you purchase Mental Mamba PLUS on one device, you can restore your subscription on other devices signed into the same Apple ID at no additional cost. To restore your purchase:

• Open Mental Mamba on your new device
• Tap the subscription/paywall screen when prompted
• Tap "Restore Purchases" at the bottom of the screen
• Your subscription will be verified and activated

7.9 Price Changes

We reserve the right to modify subscription pricing at any time. Price changes will not affect existing subscribers until their next renewal period. We will notify you of price increases at least 30 days in advance through:

• In-app notification
• Email to your registered email address (if you have an account)
• Update to these Terms of Service

If you do not agree to a price change, you may cancel your subscription before the new price takes effect.

7.10 Modification or Discontinuation of Service

We reserve the right to modify, suspend, or discontinue Mental Mamba PLUS (or any part of it) at any time, with or without notice. This includes:

• Adding or removing features from the PLUS subscription
• Changing the structure or tiers of subscriptions
• Discontinuing the service entirely

In the event of service discontinuation, active subscribers will be notified and will continue to receive access through the end of their paid subscription period. No refunds will be provided for modification of features unless required by law.

7.11 Other In-App Purchases

The App may offer other in-app purchases for virtual items or features in the future. All such purchases are final and non-refundable unless required by applicable law.

8. Data Usage and Analytics

Mental Mamba collects analytics data to improve the App and provide a better gaming experience. By using the App, you consent to:

• Anonymous Analytics: Collection of anonymous usage data, performance metrics, and crash reports when using the App without an account
• Authenticated Analytics: Collection of usage data linked to your User ID when you are logged in, including game statistics, feature usage, and session data
• Performance Monitoring: Automatic collection of app performance data, error logs, and diagnostic information to improve stability

All data collection is governed by our Privacy Policy. You may use the App without an account to limit data collection to anonymous analytics only.

9. Privacy and Third-Party Services

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

The App uses third-party services that may collect information about you:

• AWS Cognito: For secure authentication and identity management
• AWS Services: For hosting, data storage, and backend infrastructure
• Revenue Cat: For subscription management and in-app purchase processing
• Google AdMob: For displaying advertisements (not shown to PLUS subscribers)
• Apple Game Center: For leaderboards and achievements (iOS only, optional)

Each third-party service has its own privacy policy governing the use of your information.

10. Advertising

The free version of the App displays advertisements provided by third parties, including Google AdMob. These ads help support the free availability of the App. By using the free version of the App, you agree to the display of advertisements.

Mental Mamba PLUS subscribers enjoy an ad-free experience. Advertisements are automatically disabled for all active PLUS subscribers.

Free tier users may adjust their device's advertising preferences to limit personalized ads. However, advertisements will still be displayed, which may be less relevant to your interests.

11. Leaderboards and Competitive Features

Mental Mamba offers leaderboards where your username and scores are publicly displayed. By participating in leaderboards, you:

• Consent to public display of your username and game scores
• Agree not to use cheats, hacks, or exploits to gain unfair advantages
• Understand that we may remove scores or accounts that violate fair play policies
• Acknowledge that leaderboard rankings are provided "as is" without guarantees

Your email address is never displayed publicly on leaderboards.

12. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be error-free, secure, uninterrupted, or available at all times. Your use of the App is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, Australa Limited and Mental Mamba shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, arising from:

• Your use or inability to use the App
• Unauthorized access to or alteration of your data
• Any third-party conduct or content on the App
• Any interruption or cessation of the App

14. Termination

We may terminate or suspend your account and access to the App immediately, at our sole discretion, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms of Service
• Cheating, hacking, or using unauthorized tools
• Abusive behavior or harassment of other users
• Fraudulent or illegal activity

Upon termination, your right to use the App will immediately cease. You may also delete your account at any time through the Account Settings or by contacting us.

15. Updates and Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Updating the "Last Updated" date at the top of these Terms
• Posting the new Terms on our website and in the App
• Sending an email notification to registered users (for significant changes)

Your continued use of the App after changes to these Terms constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the App.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Australa Limited is a company registered in the United Kingdom.

17. Dispute Resolution

Any disputes arising from these Terms or the use of the App will be resolved through good faith negotiations. If negotiations fail, disputes will be resolved through binding arbitration or in the courts of England and Wales, except where prohibited by law.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law. The invalid provision will be deemed modified to the minimum extent necessary to make it valid and enforceable.
