1. Acceptance of Terms
By downloading, installing, or using Mental Mamba (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Australa Limited ("we", "us", "our") regarding your use of the App. By using the App, you also agree to our Privacy Policy, which explains how we collect and use your information.
2. Description of Service
Mental Mamba is a mobile game that combines classic snake gameplay with mathematical challenges. The App includes features such as:
- Core gameplay (available without an account)
- Optional user accounts with email authentication
- Global leaderboards and rankings
- Achievements and progress tracking
- Game Center integration (iOS only)
- Cross-device progress sync for authenticated users
- Analytics to improve user experience
You may use the App without creating an account, but certain features (leaderboards, achievements, progress sync) require account creation.
3. User Accounts and Authentication
3.1 Account Creation
To access certain features, you may create an account. Account creation requires providing a valid email address. We use a passwordless authentication system - you will receive a one-time verification code via email to log in.
3.2 Account Requirements
When you create an account, you agree to:
- Accurate Information: Provide a valid email address you have access to
- Age Requirement: Be at least 13 years old (or have parental consent if under 13)
- Unique Account: Create only one account per person
- Account Security: Maintain control of your email account used for authentication
- Appropriate Username: Choose a username that is not offensive, misleading, or infringes on others' rights
- Account Responsibility: Be responsible for all activities under your account
- Unauthorized Use: Notify us immediately at support.mentalmamba@australa.co if you suspect unauthorized access
3.3 Account Data and Consent
By creating an account, you consent to the collection, storage, and processing of your data as described in our Privacy Policy. This includes:
- Email address for authentication and communication
- Username and profile information
- Game statistics, scores, and achievements
- Usage analytics and session data linked to your account
You can delete your account at any time through the Account Settings in the App or by contacting us.
4. Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You may not:
- Cheat, hack, or use unauthorized third-party software
- Exploit bugs or glitches for unfair advantage
- Harass, abuse, or harm other users
- Share inappropriate content or usernames
- Attempt to reverse engineer or modify the App
- Use the App for commercial purposes without permission
5. User-Generated Content
Any content you create or share through the App (usernames, messages, etc.) must comply with our community guidelines. We reserve the right to remove any content that violates these Terms.
6. Intellectual Property
The App and all its contents, features, and functionality are owned by Mental Mamba and are protected by copyright, trademark, and other intellectual property laws.
7. In-App Purchases and Virtual Items
The App may offer in-app purchases for virtual items or premium features. All purchases are final and non-refundable unless required by applicable law.
8. Data Usage and Analytics
Mental Mamba collects analytics data to improve the App and provide a better gaming experience. By using the App, you consent to:
- Anonymous Analytics: Collection of anonymous usage data, performance metrics, and crash reports when using the App without an account
- Authenticated Analytics: Collection of usage data linked to your User ID when you are logged in, including game statistics, feature usage, and session data
- Performance Monitoring: Automatic collection of app performance data, error logs, and diagnostic information to improve stability
All data collection is governed by our Privacy Policy. You may use the App without an account to limit data collection to anonymous analytics only.
9. Privacy and Third-Party Services
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
The App uses third-party services that may collect information about you:
- AWS Cognito: For secure authentication and identity management
- AWS Services: For hosting, data storage, and backend infrastructure
- Google AdMob: For displaying advertisements
- Apple Game Center: For leaderboards and achievements (iOS only, optional)
Each third-party service has its own privacy policy governing the use of your information.
10. Advertising
The App may display advertisements provided by third parties, including Google AdMob. These ads help support the free availability of the App. By using the App, you agree to the display of advertisements.
You may adjust your device's advertising preferences to limit personalized ads. However, you will still see advertisements, which may be less relevant to your interests.
11. Leaderboards and Competitive Features
Mental Mamba offers leaderboards where your username and scores are publicly displayed. By participating in leaderboards, you:
- Consent to public display of your username and game scores
- Agree not to use cheats, hacks, or exploits to gain unfair advantages
- Understand that we may remove scores or accounts that violate fair play policies
- Acknowledge that leaderboard rankings are provided "as is" without guarantees
Your email address is never displayed publicly on leaderboards.
12. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be error-free, secure, uninterrupted, or available at all times. Your use of the App is at your own risk.
13. Limitation of Liability
To the maximum extent permitted by law, Australa Limited and Mental Mamba shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, arising from:
- Your use or inability to use the App
- Unauthorized access to or alteration of your data
- Any third-party conduct or content on the App
- Any interruption or cessation of the App
14. Termination
We may terminate or suspend your account and access to the App immediately, at our sole discretion, without prior notice or liability, for any reason, including but not limited to:
- Violation of these Terms of Service
- Cheating, hacking, or using unauthorized tools
- Abusive behavior or harassment of other users
- Fraudulent or illegal activity
Upon termination, your right to use the App will immediately cease. You may also delete your account at any time through the Account Settings or by contacting us.
15. Updates and Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Updating the "Last Updated" date at the top of these Terms
- Posting the new Terms on our website and in the App
- Sending an email notification to registered users (for significant changes)
Your continued use of the App after changes to these Terms constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the App.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Australa Limited is a company registered in the United Kingdom.
17. Dispute Resolution
Any disputes arising from these Terms or the use of the App will be resolved through good faith negotiations. If negotiations fail, disputes will be resolved through binding arbitration or in the courts of England and Wales, except where prohibited by law.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law. The invalid provision will be deemed modified to the minimum extent necessary to make it valid and enforceable.
